GAME4 Terms of Service

1) Acceptance of these Terms

These Terms govern your access to and use of our websites, apps, and services (the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy (see /privacy). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization; "you" includes that organization.

2) Who may use the Service

The Service is designed for coaches and organizations. We do not set a minimum age to create an account. You are responsible for complying with the laws of your jurisdiction regarding minors. If you upload information about athletes—including minors—you confirm you have the authority and any required permissions/consents (e.g., parental/guardian consent where required, such as in Québec for individuals under 14).

3) Accounts and administrators

You are responsible for your account, credentials, and all activity. Organizational accounts may designate administrators to manage users, permissions, billing, and content visibility. Organization admins are responsible for obtaining required consents and ensuring appropriate access to personal information stored in the Service.

4) Subscriptions, billing, and taxes

Parts of the Service are offered by subscription. Subscriptions auto-renew at the end of each billing cycle (monthly or annually) until cancelled. You can cancel any time in your account settings; cancellation takes effect at the end of the current term. Prices are shown in Canadian dollars (CAD) unless stated otherwise and are exclusive of taxes; applicable taxes will be added at checkout. We may change prices with at least 30 days' notice (email or in-product notice).

Payments: We use Stripe as our payment processor. Your payments are processed by Stripe under its terms and privacy policy. We do not store complete payment card numbers on our systems. If a charge fails, we may suspend access after reasonable attempts to obtain payment.

5) Free trials and promotions

We offer a 10-day free trial. Unless stated otherwise at sign-up, the trial automatically converts to a paid subscription at the then-current rate unless you cancel before the trial ends. The first charge posts after the trial period. Trials are limited to one per account (and we may restrict multiple trials reasonably to prevent abuse). Any additional promotional terms will be presented at sign-up.

6) Refund policy

• Monthly subscriptions: Payments are non-refundable, and there are no credits for partial periods, unless required by law.
• Annual subscriptions: You may request a refund within 14 days of the initial annual charge (including renewals). After 14 days, payments are non-refundable, unless required by law.

7) Your content & licenses

You own your content. You retain rights to drills, plans, documents, videos, comments, and other materials you upload or create ("User Content"). To operate the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, reproduce, process, adapt, transmit, display, and distribute your User Content solely to provide, secure, and improve the Service (including enabling your chosen sharing settings).

Showcasing: If you make content public, you grant us a limited license to display and promote that specific public content (e.g., in galleries or marketing) while it remains public; you can revoke future use by making it private or contacting us. We do not sell personal information.

8) AI features & anonymized data

We may use anonymized information derived from your User Content and usage (e.g., drill diagrams, practice plans, usage logs) to develop and improve GAME4 features, including machine-learning models. "Anonymized" means it cannot reasonably be linked to an identifiable individual, and we do not attempt to re-identify it. Where required (e.g., Québec), we follow applicable anonymization rules and keep required records.

Opt-out (orgs): Organization admins may opt out of model-improvement use of anonymized data derived from their workspace by emailing support@game4.app (this does not affect anonymized use for safety, security, or service integrity).

9) Acceptable use

You agree not to: (a) violate laws or third-party rights; (b) upload or share unlawful, infringing, defamatory, harassing, hateful, exploitative, or privacy-invasive content; (c) attempt to gain unauthorized access to, or disrupt, the Service; (d) reverse engineer or copy the Service except as permitted by law; (e) upload malware or harmful code; (f) use the Service to identify or contact minors without proper authority/consent; (g) scrape or bulk-export content in ways that circumvent product limits. We may remove content or suspend accounts for violations.

10) Safety & coaching disclaimer (no professional advice)

Content and AI outputs may include training ideas, drills, or diagrams. They are informational only and not medical, safety, or legal advice. You are responsible for safe execution, risk assessment, and compliance with sport rules and facility policies. Consider athlete age, health, and ability; consult appropriate professionals where needed.

11) Third-party services, analytics, and advertising

The Service may link to or integrate third-party services (e.g., video hosting, file storage, payments, analytics, advertising). Your use of those services is governed by their terms and policies. We use Google Analytics 4 for analytics and Google AdSense for advertising on our websites; see our Privacy Policy for details and opt-out controls.

12) Intellectual property; feedback

The Service (including software, designs, and trademarks) is owned by GAME4 and its licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service under these Terms. If you provide feedback or suggestions, you grant GAME4 a perpetual, irrevocable, worldwide, royalty-free license to use that feedback without obligation.

13) Changes to the Service

We may add, change, or discontinue features, and we may impose or change usage limits. If a change materially reduces core paid functionality for an active paid subscription, you may cancel and, where required by law, we will provide a pro-rated refund for the unused portion of the current term.

14) Termination

You may stop using the Service at any time. We may suspend or terminate access with notice if you materially breach these Terms, fail to pay fees, or if we discontinue the Service. On termination, your license ends and we may delete your content after a reasonable period, subject to legal obligations and our Privacy Policy.

15) Data handling & privacy

Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy. By using the Service, you consent to those practices, including processing by service providers in Canada, the United States, or other countries, with contractual safeguards.

16) Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim all warranties and conditions, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that content will meet your needs. Residents of Québec and other jurisdictions with mandatory consumer rights: these disclaimers apply only to the extent permitted by your laws.

17) Limitation of liability

To the maximum extent permitted by law, GAME4 and its affiliates, directors, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for all claims relating to the Service will not exceed the greater of CAD $50 or the amounts you paid to GAME4 in the 12 months before the event giving rise to liability. Residents of Québec and similar jurisdictions: limitations apply only as permitted by local law.

18) Indemnification

You will defend, indemnify, and hold harmless GAME4 and its affiliates, directors, employees, and suppliers from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

19) Governing law & venue

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict-of-laws rules. Except where prohibited by law, the parties submit to the exclusive jurisdiction of the courts in Ottawa, Ontario.

20) Notices; electronic communications

We may send notices by email, in-product messages, or by posting to our site. You agree to receive electronic communications related to your account and the Service. Legal notices to GAME4 should be sent to support@game4.app and to the mailing address above.

21) Copyright & IP complaints

If you believe content infringes your rights, email support@game4.app with: (a) your contact details; (b) identification of the work or rights claimed; (c) the URL or location of the material; (d) a statement of good-faith belief; and (e) a statement that the information is accurate and you are authorized to act. We may remove or disable access to alleged infringing material and may terminate repeat infringers.

22) Export & sanctions compliance

You agree to comply with applicable export control and sanctions laws. You may not use the Service if you are subject to a relevant government embargo or sanctions list.

23) Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., email or in-product). Changes take effect on the posted effective date. Your continued use of the Service after changes become effective constitutes acceptance.
